Application to An Bord Pleanála for approval under Section 177AE of the Planning and Development Act 2000 (as amended) and the Planning and Development Regulations 2001 (as amended)

Kilkenny County Council has applied to An Bord Pleanala for permission to construct a route for pedestrians and cyclists on lands between the River Nore Linear Park (Bishops Meadows) and the Riverside Garden (Abbey Quarter) at the townland of Gardens in Kilkenny City.

In compliance with a request from An Bord Pleanala, Kilkenny County Council hereby advises, by way of clarification to the public notice dated Friday 20th October 2023, that Article 120(3) of Planning and Development Regulations 2001 (as amended) does apply to this application.

Furthermore, Kilkenny County Council also advises that  the new closing date for receipt of observations or submissions to 5.30pm on Friday 15th December 2023.   Submissions or observations must be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, D01 V902

As per the public notice dated 20th October 2023, a copy of the particulars of the proposed development, including the Natura Impact Statement, is available for inspection at the following locations, with the details now available for inspection until Friday 15th December 2023.

Application to An Bord Pleanála for approval under Section 177AE of the Planning and Development Act 2000 (as amended) and the Planning and Development Regulations 2001 (as amended)

Notice is hereby given that Kilkenny County Council proposes to seek the approval of An Bord Pleanála to construct a route for pedestrians and cyclists on lands between the River Nore Linear Park (Bishops Meadows) and the Riverside Garden (Abbey Quarter) at the townland of Gardens in Kilkenny City.

The proposed development comprises the provision of a pathway for pedestrians and cyclists between River Nore Linear Park (Bishops Meadows) and Riverside Garden (Abbey Quarter). A section of the pathway will be constructed as an elevated boardwalk along the western bank of the river Nore. The proposed development also includes public lighting, surfacing and associated site clearance works. To the North, the pathway will connect to the existing riverside walk at Bishops Meadows. To the South, the pathway will cross beneath the R886 (New Road) through an existing arch which forms part of the western approach to Green’s Bridge.

A Natura Impact Statement has been prepared as part of the application for approval in respect of the proposed development.

An Bord Pleanála may give approval to the application for development with or without conditions, or may refuse the application for development. A copy of the particulars of the proposed development, including the Natura Impact Statement will be available to inspect at:

In accordance with the requirements of Article 120(1)(a) of the Planning and Development Regulations 2001 (as amended), the local authority has made a preliminary examination of the nature, size and location of the proposed development.  The authority has concluded that there is no real likelihood of significant effects on the environment arising from the proposed development and a determination has been made that an Environmental Impact Assessment (EIA) is not required.

As per Article 120(3) where any person considers that the development proposed to be carried out would be likely to have significant effects on the environment, he or she may, at any time before the expiration of 4 weeks beginning on the date of the publication of this notice apply to An Bord Pleanála for a screening determination as to whether the development would be likely to have a significant effect on the environment.

Copies of the Natura Impact Statement may be inspected free of charge or purchased on payment of a specified fee (which shall not exceed the reasonable cost of making a copy).

Submissions or observations may be made to An Bord Pleanála on the proposed development in relation to:

  1. The implications of the proposed development on the proper planning and sustainable development in the area concerned,
  2. The likely effects on the environment of the proposed development, and
  3. The likely significant effects of the proposed development on a European Site if carried out.

Any submissions or observations may be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, D01V902 and received by An Bord Pleanála not later than 5.30pm on Friday 01st December 2023 Friday 15th December 2023.

A person may question the validity of a decision of the Bord by way of an application for judicial review, under Order 84 of the rules of the Superior Courts (S.I. No.15 of 1986) in accordance with section 50 of the Planning and Development Act 2000 (as amended).
