KILKENNY COUNTY COUNCIL HOUSING COMPULSORY PURCHASE ORDERS 2022
COMPULSORY PURCHASE ORDERS AS PROVIDED FOR BY SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966 AS AMENDED BY THE PLANNING AND DEVELOPMENT ACT, 2000, AS AMENDED HOUSING ACT 1966 SECTION 10 OF THE LOCAL GOVERNMENT (IRELAND) ACT, 1898, AS AMENDED BY SECTION 11 OF THE LOCAL GOVERNMENT (NO.2) ACT 1960 AND SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT 2000
Kilkenny County Council (hereinafter referred to as “the housing authority”) in exercise of the powers conferred upon them by section 76 of the Housing Act, 1966, and the Third Schedule thereto (as amended by the Planning and Development Act, 2000), have made a number of orders for compulsory purchase which are about to be submitted to An Bord Pleanála for confirmation. If confirmed, the orders will authorise the housing authority to acquire compulsorily the land applied for in the following compulsory purchase orders:
1) CPO 1 of 2022 Former Garda Barracks, Castlecomer, Co. Kilkenny
2) CPO 2 of 2022 Main Street, Gowran, Co. Kilkenny
3) CPO 3 of 2022 12 Wolfe Tone Street, Kilkenny
4) CPO 4 of 2022 Lands at Waterbarrack / The Butts, Kilkenny
A copy of the orders and of the maps referred to in it can be viewed on this website and will also be available for inspection, or purchase at a fee not exceeding the reasonable cost of making a copy, from Friday 11th February 2022 to Tuesday 15th March 2022 inclusive at:- the Planning Department, Kilkenny County Council, County Hall, Johns Street, Kilkenny City - from 9am to 1pm & 2pm to 4.00pm Monday to Friday (Except Public Holidays) by appointment only. The Housing Act, 1966, as amended, provides that the Board cannot confirm the order in respect of any land being Compulsorarily Purchased if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn, until it has held an oral hearing into the objection and until it has considered the objection and the report of the person who held the oral hearing. An Bord Pleanála has an absolute discretion under Section 218 of the Planning and Development Act, 2000 (as amended) to hold an oral hearing.
Objections to the any of the Compulsory Purchase Orders should be addressed to An Bord Pleanála, 64, Marlborough Street, Dublin so as to reach the Board before 5.30pm on the 15th March 2022. KILKENNY COUNTY COUNCIL CANNOT ACCEPT OBJECTIONS ON BEHALF OF AN BORD PLEANALA.
