NOTICE OF INTENTION TO UNDERTAKE DEVELOPMENT BY A LOCAL AUTHORITY UNDER SECTION 179A OF THE PLANNING AND DEVELOPMENT ACT, 2000 (as amended)

In accordance with the provisions of Section 179A of the Planning and Development Act 2000 (as amended) Kilkenny County Council gives notice of its intention to carry out the following development:

Construction of 42 no. Houses and Apartments and Associated Site Works including Roadways, Parking and Amenity Areas at Newtown, Thomastown, Co. Kilkenny.

  • Main Items which may be of interest:

  • The intention is to allocate the homes to housing applicants on the approved housing list for Thomastown, in accordance with the scheme of letting priorities. However the sale of affordable homes in the scheme to qualified applicants may be considered if a suitable scheme is available. 

Breakdown of proposed units is as follows:-

28 no. Houses - 6 x 2 bed, 20 x 3 bed & 2 x 4 bed

14 no. Apartments - 10 x 1 bed, 2 x 3 bed & 2 x 3 bed fully wheelchair accessible

This breakdown is based on the social housing need for Thomastown i.e. 48% 1beds, 34% 2 beds, 15% 3 beds and 3% 4 beds. 

  • The project is approved for funding from the Department of Housing, Planning and Local Government and forms a key part of Kilkenny County Councils Housing Strategy to deliver new build homes in Kilkenny County.
  • An Archaeological Impact Assessment was carried out which concluded that there indicated no known recorded archaeological monument within the Study Area it was considered that the proposed construction of housing on the site will have no adverse archaeological impact.
  • An AA Screening Report has been prepared, which showed that no significant environmental impact is likely on any Natura 2000 site, its conservation objectives and integrity either separately or in combination with other developments. The proposed development will be connected to Irish Water public water, storm water drainage and waste water infrastructure. The Planning Authority as the competent authority considers that there is no requirement for a Stage 2 Natura Impact Statement (NIS) as other than best practice design no specific ecological mitigation measures are necessary.
  • An Environmental Impact Assessment Screening has been prepared which on examination of the nature, size and location of the proposed development has determined that there is no real likelihood of significant effects on the environment arising from the proposed development. It is therefore concluded that an EIAR is not required.

  • Irish Water has provided confirmation that water and wastewater connections are feasible for the site. A formal connection application will be submitted to Irish Water in due course. 
  • A Site Specific Flood Risk Assessment has been prepared in which the site of the proposed development has been screened, scoped and assessed for flood risk in accordance with flood risk guidelines. The assessment and analysis undertaken as part of this Site Specific Flood Risk Assessment indicates that the site of proposed development is not susceptible to predictive, indicative, historic or anecdotal fluvial, pluvial or groundwater flooding.  It is recommended that the development as proposed incorporates an appropriate storm-water management system which limits post development storm-water runoff from the site to predevelopment greenfield runoff rates.

In accordance with the provisions of Section 179A of the Planning and Development Act 2000 (as amended) Kilkenny County Council gives notice of its intention to carry out the following development:

Plans and particulars of the proposed development will be available for inspection or purchase for a fee not exceeding the reasonable cost of making a copy during office hours from Planning Dept., Kilkenny County Council, County Hall, John St., Kilkenny City from 9am to 1pm & 2pm to 4pm Monday to Friday (excluding weekends and Bank Holidays) and can be viewed online at https://consult.kilkenny.ie/

Screening Determination:- In accordance with the requirements of Article 120(1)(a) of the Planning and Development Regulations 2001 (as amended) the Planning authority has made a preliminary examination of the nature, size and location of the proposed development.  The authority has concluded that there is no real likelihood of significant effects on the environment arising from the proposed development and a determination has been made that an Environmental Impact Assessment (EIA) is not required. The authority has concluded that there is no likelihood of significant effects on a European Site and that an Appropriate Assessment is not required. As per Article 120(3) of the Planning and Development Regulations 2001 (as amended), where any person considers that the development proposed to be carried out would be likely to have significant effects on the environment, he or she may, at any time before the expiration of 4 weeks beginning on the date of the publication of this updated notice apply to An Bord Pleanála for a screening determination as to whether the development would be likely to have a significant effect on the environment.

Within a period of 8 weeks from the date of this notice any person may question the validity of any decision of the Planning Authority by way of an application for judicial review. The development will not commence until this period of 8 weeks has expired
